Self-defense Law?

A boat is sinking in deathly freezing water, no help for hours, only one life boat. Passengers on life boat about to be capsized by other passengers in water. One man shoots and beats swimmers to save the his life and the life of the passengers on the boat. He also throws 5 people overboard ultimately to their deaths with no discrimination to allow the boat not to capsize in the choppy rough water. Upon rescue man is arrested for murder. Several surviving passengers testify on his behalf, swearing that all would have died if he had not acted the way he did.
What should be the proper verdict?

This is not a self defense question. You are asking if the acts of murder are excusable.

Here, I believe, circumstances dictate excusable murder.

Some years ago a fire broke out on a small yacht with six people aboard. The fire quickly engulfed the boat. A man and his girlfriend managed to get a small rubber raft into the water and get away from the boat. The other four passengers jumped into the water, only one had a life preserver. All four started swimming for the raft. The man in the raft realized that six persons could not fit in the raft and there were no provisions in the raft. He rowed away from the swimmers. Three drowned. About 20 MINUTES after that a rescue helicopter showed up. The explosion and fire had been seen by a passing private plane who radioed the Coast Guard. That man went to prison for manslaughter.
