Why do people claim that shooting a criminal is equal to capital punishment?
I've seen alot of people say that it's equal to capital punishment for muggers if you let people shoot in self defence.
It isn't.
Capital punishment is an action of the state where the criminal is already in custody and the public are already safe.
Shooting someone who is trying to hurt you or take your property by force is stopping a crime from being commited, the fact that lethal force is used doesn't automtically equate it to capital punishment.
And while you could spend years arguing over the morality of killing, even in self defense, that doesn't make it moral to deny others the right to protect themselves.
I've seen it said 5 times since i started reading on gun control.
It comes down to the meaning of life and human rights, but I won't go into that. The problem comes in trying to prove self defence and how to draw the line between murder and self defence.
The murder comes in and attacks you. You shoot him in self defence and miss. He shoots you and injures you - he claims it's self defence and you are in the wrong. It's making sure the person if guilty also. The wrong thing with capital punishment is proving 100% the person is guilty and the same decision comes with self defence when killing someone, how do you know he is doing what you think he is doing. I am a Briton and do no believe in Capital Punishment of self defence where a gun is involved.

shooting someone while in an occupied car. Would it be justified as self defense?
Lets say if you accidently cut off another driver, then you stop at a red light, and the other driver is mad, so he gets out of his car, approaches you, opens your car door, and you shoot him dead, Would you still go to jail?
Or if they open your car door, should you wait till they put their hands on you to shoot them, using lethal force , would you still go to jail? I did hear that is the castle law, and you will be protected from prosecution.
Who knows the facts? As of me, I own a gun, and keep one in my car with me, and I would shoot them because you dont know what they are going to do to you.
I only know the law in my state of California that You can only defend your self with deadly force if the person is directly trying to kill you,so if they open your car door that would in no way justify you killing them.Even if they did open your car door and try to assualt you that would still probably not justify you either.In most states like California it is illegal to carry around a concealed weapon unless you have a special license which is fairly hard to get.I am a proud gun owner but the only time I would remotely think about doing something like that would be if someone broke into my house and tried to directly hurt my family and even then you would still probably wind up getting arrested or heavily questioned by police and have to go to court and prove what you did was justified.
