I want to write a disclaimer for an employee refusing to wear safety shoes which have been provided??r=1253184?



I don't think a disclaimer will let you off the hook. Health and Safety Regs cannot be got round by writing disclaimers. If it is the law that he should wear safety shoes and he won't comply, fire him. By refusing to wear safety equipment required by law, he is putting his own safety and that of his coworkers in jeopardy.

You don't say what environment he is working in, but if he were on a building site and something fell on his foot and he dropped a tool from a height that hit another person, you personally would be liable as you allowed him on site without proper PPS equipment. A disclaimer would not exonerate you at all. On the contrary, you would be seen to be coluding in encouraging the risk.

EDIT Ask this worker would he rather wear safety shoes or a prosthetic foot.
