Can a victim of domestic abuse be charged with domestic assault for hitting her husband in self defense?
My friend is a victim of domestic abuse. She moved out of her husband's house and then went back tonight due to persistent calling from a mutual friend. She had a few drinks and when she went to find her husband at the bar, he was with another woman. She started to shout at him, and he said he wanted to take it outside. Once outside, he started to push her around, so she started swinging at him. She had her car keys in her hand which caused him to get cut up. When the police arrived, they charged her with domestic assault, despite the bruises that are still on her arms from his beating a few days ago and said that they were old, and that he was the injured party.
There are still threatening voice messages on her cell from him over the weekend, and he called and threatened to kill a friend of hers on Friday night. Is there something that she can do, such as battered spouse syndrome, to help her out of this mess? She lives in MN.
Its not uncommon for both spouses in a messed up marriage to be charged over time with assault. While there are many cases of self defense where one spouse defends themselves and it causes injury to the other spouse, there are many where both keep beating on each other. It sounds like in THIS case, from your description, she sought him out, did the most damage and was rightfully charged for THIS incident. The bruising from the previous fight is another story. It sounds like they both need to leave.
Edit- She need to make another report about the threats and she can contact victim services, or the Crisis Unit, or Shelter for battered women... depending on the services in her city.

Yes. There's a huge amount of evidence proving an abused spouse is likely to be killed. The laws don't help that much. An abused spouse can try to leave and get a restraining order, but the kind of person who beats their spouse is not going to care about that piece of paper. By the time they are arrested for violating the order, you are dead.
I volunteer at a battered women's shelter, and the first thing we do is get the women TPO's. The husbands often keep showing up anyway. They hunt them down, and not only do they harass the women, they harass us. At some point, killing the abuser is simply self defense.
